By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

 

1. Use of Services

 

You may use our Services only in compliance with these Terms and all applicable laws. You agree not to misuse our Services or help anyone else do so. Specifically, you agree not to:

- Reverse engineer, decompile, or disassemble any part of our Services

- Use the Services for any unlawful purpose

- Attempt to gain unauthorized access to our systems

- Interfere with the proper operation of the Services

- Use automated tools to access the Services in a manner that exceeds reasonable usage

 

2. API Access and Usage

 

Access to our APIs requires valid authentication credentials. You are responsible for maintaining the confidentiality of your API keys. Usage is subject to the rate limits and quotas specified in your subscription plan.

 

3. Intellectual Property

 

All content, features, and functionality of our Services are owned by BrainiAll Inc. and are protected by copyright, trademark, and other intellectual property laws. Our proprietary AI models, scoring algorithms, and related technology remain our exclusive property.

 

4. Subscription and Payment

 

Certain Services require a paid subscription. Payment terms are governed by the applicable marketplace or billing agreement (e.g., Microsoft Azure Marketplace, AWS Marketplace). Subscriptions automatically renew unless cancelled before the renewal date.

 

5. Data Processing

 

We process audio data and text input solely for the purpose of providing pronunciation assessment services. Audio data is processed in real-time and is not stored after the assessment is complete, unless otherwise specified in your service agreement.

 

6. Disclaimer of Warranties

 

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

 

7. Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINIALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

 

8. Modifications

 

We may modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the modified Terms.

 

9. Governing Law

 

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
